Marketplace Terms & Conditions

These Reiseathleten Marketplace Terms & Conditions apply to bookings of partner retreats that are requested, confirmed, or partially paid through the Reiseathleten marketplace. They supplement the retreat-specific details shown on the listing page and any host-specific terms. In case of conflict, these marketplace terms prevail for platform flow, communication rules, and the initial payment step.

1. Scope

1.1 These terms apply to all guests and hosts who list, request, confirm, or fulfill partner retreats through the Reiseathleten marketplace.

1.2 They apply only to the marketplace and intermediation flow for partner retreats. Different terms may apply to Reiseathleten-operated trips or other services.

1.3 Mandatory consumer protection rights remain unaffected.

2. Role of Reiseathleten and the Host

2.1 Reiseathleten operates the marketplace and provides the technical platform for booking requests, availability coordination, the first payment step, and communication during the booking process.

2.2 Reiseathleten is not the organiser of the partner retreats offered on the marketplace and does not provide these services itself.

2.3 The host named on the relevant retreat page is the sole organiser, operator, and service provider of the partner retreat. In particular, the host is responsible for:

• the substantive accuracy of the listing
• the delivery of the retreat
• compliance with local regulations
• the host's own cancellation rules
• refunds for services not provided

2.4 Host-specific terms and conditions or policies are effective only insofar as they do not conflict with these Reiseathleten Marketplace Terms & Conditions. For the platform process, on-platform communication, and the first payment step, these marketplace terms prevail.

3. Booking Flow and Contract Formation

3.1 A booking request submitted through Reiseathleten is the guest's binding offer to book the selected partner retreat on the terms shown on the platform.

3.2 For partner retreats, the host first checks availability. Only after this availability confirmation is the guest given the opportunity on the platform to complete the final confirmation and, where applicable, make an initial deposit.

3.3 A binding booking contract is concluded exclusively between the guest and the host once:

• the guest completes the required confirmation within the displayed time window and
• any envisaged initial deposit has been successfully made

3.4 Reiseathleten does not become a party to the booking contract between the guest and the host.

3.5 If the confirmation window expires, the spot may be released again without further notice.

3.6 Pure messages, saved items, open carts, price discussions outside checkout, or non-binding preliminary contacts do not give rise to any claim that a contract will be concluded.

4. On-Platform Communication and Anti-Circumvention

4.1 Until the booking has been confirmed and any required first payment step has been completed, all booking-relevant messages, price arrangements, mandatory information, and calls to action must take place on the Reiseathleten platform.

4.2 Before that point, it is prohibited to direct guests or hosts to external communication or payment channels, or to request such use, in order to circumvent the platform (e.g. email, telephone, WhatsApp, external websites, or payment links).

4.3 It is equally prohibited to request or accept mandatory payments or fees outside the platform before the intended platform process has been completed.

4.4 After the booking has been confirmed, direct contact details may be used insofar as this is necessary for carrying out the trip, providing documents, support, or handling the remaining balance.

4.5 Reiseathleten is entitled to moderate content, remove links or contact details, display warnings, and review bookings or temporarily or permanently restrict user accounts in the event of violations of these rules.

5. Pricing, Payments, and Remaining Balance

5.1 All mandatory prices and compulsory surcharges must be clearly visible on the platform before the booking request is submitted. Hidden mandatory fees are not permitted.

5.2 An initial deposit paid through Reiseathleten is part of the total price and not an additional intermediation fee.

5.3 Payment processing is split:

• An initial deposit may be paid through the Reiseathleten platform
• The remaining balance is invoiced and collected directly by the host

5.4 The host is solely responsible for the remaining balance, in particular for:

• issuing invoices
• taxes
• payment instructions
• payment reminders

5.5 Additional claims by the host are permitted only if they were transparently disclosed before the booking was completed or were expressly accepted by the guest afterwards.

5.6 If a due payment is not made, the statutory provisions and the consequences defined in the respective booking process or in the permissible host-specific terms apply.

6. Host Obligations

6.1 The host is required to keep its listing complete, truthful, and up to date.

6.2 The host may not use Reiseathleten merely as a source of leads or systematically attempt to move bookings away from the platform.

6.3 The host is responsible for all legal requirements relating to the retreat itself (permits, insurance, taxes, etc.).

6.4 The host shall ensure that its own terms do not conflict with these terms and conditions.

6.5 The host may use only content for which it holds the necessary rights.

6.6 Brands or protected terms may be used only where the corresponding authorization exists.

6.7 The host is liable for legal infringements in its listing and shall indemnify Reiseathleten against justified third-party claims to the extent permitted by law.

6.8 Reiseathleten may review, remove, or restrict content if there are indications of legal infringements.

7. Guest Obligations

7.1 Guests must provide correct and complete information.

7.2 Guests must not misuse the platform or support circumvention.

7.3 Guests are responsible for their own health-related requirements and travel requirements.

8. Cancellations, Changes, and Refunds

8.1 For partner retreats, the host cancellation and change policy disclosed on the listing page and during checkout applies unless mandatory law or these marketplace terms require otherwise.

8.2 If a refund concerns a deposit paid through the platform, Reiseathleten may support this administratively within the framework of the applicable rules.

8.3 If a refund concerns payments made to the host, the host alone is responsible for handling it.

8.4 Reiseathleten may restrict bookings or processes if this is necessary for security, compliance, or misuse-prevention reasons.

9. Liability

9.1 Reiseathleten is liable within the scope of the statutory provisions for providing the platform.

9.2 Reiseathleten is not liable for the performance of the retreats, as these are provided exclusively by the host.

9.3 The host is solely responsible for all claims arising from the performance or non-performance of the retreat.

9.4 Limitations of liability do not apply in cases of intent, gross negligence, or injury to life, body, or health.

10. Privacy and Platform Control

10.1 Reiseathleten may process data insofar as this is necessary for booking processing, misuse prevention, and support.

10.2 Hosts may use data only for carrying out the booking.

10.3 Otherwise, the privacy policy applies.

11. Final Provisions

11.1 German law applies.

11.2 For merchants, the place of jurisdiction is the registered office of Reiseathleten.

11.3 Should individual provisions be invalid, the remainder shall remain effective.
